Welcome to Calmiu. These Terms of Service ("Terms") govern your use of the Calmiu mobile application ("App") operated by Calmiu ("we," "us," or "our"). By accessing or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using Calmiu, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App.

2. Age Requirement

Calmiu is intended for users who are 18 years of age or older. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use Calmiu.

3. Description of Service

Calmiu is a mobile application that allows users to:

• Create and maintain personal diaries and journal entries
• Capture and organize photos and memories
• Track emotions and moods
• Discover and connect movies to their emotional experiences
• Access AI-powered insights and movie recommendations
• Organize memories in albums
• Track expenses and timeline activities

4. Subscription Services

4.1 Premium Subscription

Calmiu offers a Premium subscription service that provides access to advanced features, including but not limited to:

• Unlimited cloud storage and sync
• Advanced AI recommendations
• Premium insights and analytics
• Exclusive fonts and themes
• Export in high quality (4K)

4.2 Subscription Terms

• Subscriptions are managed through Apple App Store
• Subscription fees are charged to your Apple App Store account
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• You can manage your subscription and turn off auto-renewal in your Apple App Store account settings
• We offer various subscription plans (weekly, monthly, quarterly, yearly)
• No refunds will be provided for any unused portion of a subscription period

4.3 Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of your current billing period, and you will continue to have access to Premium features until that time.

5. User Content and Data

5.1 Your Content

You retain all ownership rights to the content you create, upload, or store within Calmiu, including diary entries, photos, and other personal information.

5.2 Local Storage

Most of your content is stored locally on your device. You are responsible for backing up your data. We are not responsible for any loss of data stored locally on your device.

5.3 Prohibited Content

You agree not to use Calmiu to create, store, or share content that:

• Is illegal, harmful, or violates any applicable laws
• Infringes on the rights of others, including intellectual property rights
• Is defamatory, abusive, harassing, or threatening
• Contains malware, viruses, or other harmful code
• Is sexually explicit or pornographic
• Promotes violence, hate speech, or discrimination

6. Intellectual Property

The App, including its design, features, functionality, and content (excluding user-generated content), is owned by Calmiu and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App without our prior written consent.

7. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Backing up your data
• Ensuring your use of the App complies with all applicable laws
• Providing accurate information when required

8. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Use automated systems or bots to access the App
• Remove or alter any copyright, trademark, or other proprietary notices

9. Disclaimers and Limitation of Liability

9.1 Service Availability

We strive to provide reliable service, but we do not guarantee that the App will be available at all times, be error-free, or meet your specific requirements. The App is provided "as is" and "as available."

9.2 Limitation of Liability

To the maximum extent permitted by law, Calmiu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the App.

9.3 Data Loss

While we take measures to protect your data, we are not responsible for any loss or corruption of data stored on your device or in cloud storage. You are responsible for maintaining backups of your important data.

10. Termination

We reserve the right to suspend or terminate your access to Calmiu at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Calmiu operates, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
